PLEASE READ CAREFULLY. THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY THAT INCLUDES THE NEGLIGENCE OF THE RELEASED PARTIES, AN ASSUMPTION OF RISK, AN INDEMNITY, A COVENANT NOT TO SUE, AND A WAIVER OF TRIAL BY JURY. BY CHECKING "I AGREE" AT CHECKOUT YOU ACCEPT IT AND GIVE UP SUBSTANTIAL LEGAL RIGHTS.
In this agreement, "I" and "me" mean the person buying or using a ticket. The event is organized by Ecstatic Dance Miami, a brand of Health & Light Institute LLC. "Released Parties" means, each individually and together: (a) Health & Light Institute LLC and its members, managers, officers, employees, facilitators, disc jockeys, guest teachers, aquatic and sound practitioners, staff, volunteers, contractors and agents; (b) Alejandro "Alex" Medin, individually and in every capacity, including as owner, host and facilitator; and (c) the owner or owners of the private residence where the event is held, its occupants, and all members of their households, together with the insurers, heirs, successors and assigns of each of them. Every Released Party is also an indemnified party under section 7.
I am at least 18 years old. No one under 18 may attend, and no parent or guardian may accept this agreement for a minor. These terms apply to every Ecstatic Dance Miami event I attend under this ticket, including any optional part of the evening.
Ecstatic Dance Miami is a conscious-movement gathering at a private residence in Hollywood, Florida. It runs into the late night, past midnight. Depending on my ticket it can include:
Ecstatic dance: free-form, barefoot, sometimes vigorous movement in a group, with low or changing light.
Aquatic Rebirthing / introduction to Watsu: immersion in a heated saltwater pool (about 95°F), being floated on my back, cradled, moved, stretched and massaged in the water by another participant or a practitioner, and doing the same for others.
Sound healing: a crystal sound bath with amplified and acoustic sound.
Social time, a potluck, a fire pit and outdoor garden areas. Some guests may use flow toys or fire.
I understand that taking part involves inherent risks that cannot be fully removed, even with reasonable care. These risks include, among others:
Physical activity: falls, collisions with other dancers, sprains, strains, fractures, overexertion, dehydration, dizziness and cardiac events.
Water: drowning or near-drowning, inhaling or swallowing water, water in the ears or sinuses, disorientation while floating with eyes closed, and the risks of being held, moved or released in water by another person.
Wet and uneven surfaces: slipping on pool decks, wet floors, steps, grass and garden areas, especially barefoot and in the dark.
Heat: warm water and warm night air can lower blood pressure and cause light-headedness, fainting or overheating.
Sound: extended exposure to loud music and sound-bath frequencies can cause ear discomfort or ringing in the ears.
Fire and flow toys: burns or impact injuries from fire pits, fire spinners, poi and spin toys used by others.
Private-residence premises: the event takes place at a private home, not a commercial venue. The premises include a swimming pool with no lifeguard on duty, pool edges and steps, indoor and outdoor stairs, uneven ground, garden areas, low lighting, furniture, and other conditions typical of a residence. The premises are not built, inspected or maintained to commercial or public-pool standards. I will enter the pool only when a facilitator says it is open and will use stairs, steps and walkways with care.
Late hours and travel: fatigue, and travel to and from a private residence at night.
Emotional release: strong emotions, memories or discomfort that may come up during dance, breathwork, water work or sound.
I EXPRESSLY, KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS, KNOWN AND UNKNOWN, INCLUDING RISKS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, and I accept full responsibility for any resulting injury, illness, death or property loss. Participation is voluntary. I may skip or stop any activity at any time, and I am responsible for staying within my own limits.
I confirm that I am in suitable physical and mental health to take part. Before taking part I will tell a facilitator, and I will not enter the pool unless a facilitator has agreed, if I:
am pregnant;
have a heart condition, high or low blood pressure, or a history of fainting;
have epilepsy or a seizure disorder;
have had surgery recently, or have open wounds, stitches, a skin infection, or any contagious condition;
have neck, spine or joint problems that could be affected by being moved or stretched;
have any other condition that could be made worse by vigorous movement, warm water, being held in water, or loud sound.
I confirm that I am not under the influence of alcohol, recreational drugs, or any substance that impairs my judgment, balance or awareness. This is an alcohol- and drug-free event. I will tell a facilitator before entering the water if I cannot swim or am not comfortable in water. I am responsible for my own medications and for telling a facilitator about any condition that matters for my safety.
The event is not a substitute for professional medical, psychological or psychiatric treatment. Nothing at the event is medical advice, diagnosis, treatment or psychotherapy, even when a facilitator is a licensed professional in another setting. Any benefits described are experiential and not guaranteed. I have consulted, or have had the chance to consult, a healthcare professional about whether these activities are right for me.
IN CONSIDERATION OF BEING ALLOWED TO ATTEND AND PARTICIPATE, I, FOR MYSELF AND MY HEIRS, SPOUSE, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE AND FOREVER ACQUIT THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES, DAMAGES AND LIABILITIES OF ANY KIND, FOR PERSONAL INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE OR LOSS, ARISING OUT OF OR RELATED TO MY ATTENDANCE AT OR PARTICIPATION IN THE EVENT OR MY PRESENCE ON THE PROPERTY, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASED PARTIES (for example, negligence in supervising activities, in instruction or facilitation, in the condition, maintenance or lighting of the residence, pool, stairs, decks, floors, grounds or equipment, in the absence of a lifeguard, or in responding to an emergency). This release includes claims against Alejandro "Alex" Medin individually and against the owners, occupants and household members of the residence under any theory of premises liability.
This release is intended to be as broad and inclusive as Florida law permits. It does not release claims for gross negligence or intentional misconduct, or any liability that cannot be released as a matter of law.
To the maximum extent permitted by law, the Released Parties will not be liable for any indirect, incidental, punitive, special or consequential damages, and any liability that is not released is limited to the amount I paid for my ticket.
I AGREE NOT TO SUE OR BRING ANY CLAIM AGAINST ANY RELEASED PARTY for any matter released above. If I, or anyone on my behalf, do so, I will pay the Released Parties' reasonable attorneys' fees and costs in defending it.
I agree to indemnify, defend and hold harmless each of the Released Parties, including Health & Light Institute LLC, Alejandro "Alex" Medin individually, and the owners, occupants and household members of the residence, from any loss, liability, claim or demand, including reasonable attorneys' fees and costs, made by me, my heirs or representatives, or any third party, arising out of or related to my participation, my conduct at the event, my breach of these terms, or my violation of any law or the rights of a third party, including claims alleged to result from the negligence of the Released Parties, except to the extent caused by their gross negligence or intentional misconduct.
Health & Light Institute LLC and its facilitators may refuse entry to, or remove from any activity or from the property, anyone whose behavior they judge to be unsafe, disruptive, impaired, or against these terms. They may also stop or change any activity for safety reasons, including keeping someone out of the pool. No refund is due when someone is removed for conduct.
Touch is always consent-based. I will ask before touching anyone, accept "no" or no answer as no, and stop immediately if asked. In the water, both the giver and the receiver may stop at any time.
No sexual behavior, harassment, intimidation or discrimination.
No alcohol or drugs, no shoes on the dance floor, and minimal talking outside the social areas.
I will follow facilitators' instructions, especially in and around the pool and fire areas.
I will keep the private location confidential and will not share the address.
I am responsible for my own belongings. The Released Parties are not responsible for lost, stolen or damaged property, including phones and valuables left in common or poolside areas.
Health & Light Institute LLC may photograph or record parts of the event and use those images to document and promote Ecstatic Dance Miami. I may opt out by telling a facilitator at check-in or by emailing [email protected]. Health & Light Institute LLC will then make reasonable efforts not to publish images in which I can be identified. I will not photograph or record other participants without their consent, and never in the pool or during the sound bath.
I am responsible for my own transportation to and from the event. Parking is very limited, so carpooling or ride-share is encouraged. Doors close at 8:00 p.m., and late arrivals may be refused.
I may cancel for a full refund up to 24 hours before the event start time. Less than 24 hours before the start, tickets are not refundable, unless Health & Light Institute LLC cancels or reschedules the event. In that case I may choose a refund or a transfer to the new date. Payment-processor or platform fees may not be refundable where the platform does not return them.
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Broward County, Florida, and I consent to that venue and jurisdiction.
WAIVER OF JURY TRIAL. I KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY in any action arising out of or related to this agreement or my participation.
If any part of these terms is found unlawful, void or unenforceable, that part will still be enforced to the fullest extent permitted by law, and the rest remains in full force. Health & Light Institute LLC's failure to enforce any provision is not a waiver of it. These terms, together with the ticket purchase, are the entire agreement about my participation. This agreement binds my heirs, representatives and assigns, and it applies to this event and any rescheduled date.
I agree that checking "I agree" at checkout is my electronic signature, with the same legal effect as a handwritten signature (Florida Uniform Electronic Transaction Act, Florida Statutes section 668.50). The date, time and version of these terms that I accept are recorded with my ticket.
I HAVE READ THIS ENTIRE AGREEMENT. I UNDERSTAND IT, INCLUDING THE RELEASE OF LIABILITY FOR THE NEGLIGENCE OF THE RELEASED PARTIES, THE ASSUMPTION OF RISK, THE INDEMNITY, THE COVENANT NOT TO SUE AND THE JURY-TRIAL WAIVER. I AM AT LEAST 18 YEARS OLD, AND I ACCEPT IT VOLUNTARILY, INTENDING IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE TO THE FULLEST EXTENT ALLOWED BY LAW.
